Q. Can teachers also use family care leave?
A. Due to the revision of the National Civil Service Service Regulations by the Ministry of Personnel Management and Innovation in October 2020, the child care leave that teachers could previously use within the range of 2 days (maximum 3 days) per year was extended to 10 days per year for immediate family members. It can now be used as care leave.

Q. Are all 10 days of family care leave paid leave?
no. If the person being cared for is a ‘minor’ or ‘disabled’ (grand) child, only 2 days (maximum 3 days*) per year are paid leave, and the rest is unpaid leave.
*If 3 days are granted per year
① Children with disabilities (regardless of number of children and age)
② In case of a single-parent family (no matter the number of children, minor children)
③ If you have two or more children (minor children)

Q. What is the reason for paid family care leave?
When participating in a child’s school (including daycare and kindergarten) closure, school closure, online classes, various school events, hospital treatment (including health checkups and vaccinations), care due to illness or accident (hereinafter referred to as nursing)*, parent consultation, etc. .
* If you have a disabled child, hospital treatment and nursing are eligible for paid family care leave regardless of the child’s age.
Q. Can family care leave be used on an hourly basis?
Paid leave can be used on an hourly basis, but unpaid leave can only be used on a daily basis.

Q. Do I need to submit a medical certificate for my child’s hospital treatment?
The Ministry of Personnel Management’s regulations state that for family care leave, the service officer (vice principal) must check the supporting documents. Therefore, you must submit relevant supporting documents, family relationship certificate, etc. In the case of hospital treatment, you do not need to submit a medical certificate, but you can submit documents that can confirm the treatment, such as a bill or receipt. Regarding events such as school, you can submit a notice or a home letter and attach a file when applying for military service.

Even in the case of unpaid family care leave, it is required to verify family relationship certificate, etc. Unpaid leave is a deduction from your monthly salary, so it is recommended that you only use it when you have no other means, such as annual leave*. For teachers who face many restrictions on the use of annual leave, which is statutory leave, there is a need to request a revision of the law so that the scope of paid family care leave can be expanded to the entire family.
* According to the established regulations on teacher leave, “when it is recognized that temporary nursing or comfort is necessary due to illness, injury, etc. of the spouse, the principal, the spouse’s immediate descendants, or brothers or sisters” [Article 5, Paragraph 1, Item 3] B. If the head of the school acknowledges that there are other reasonable grounds” [Article 5, Paragraph 1, Item 9], the school principal is required to approve annual leave during the school day for teachers.

Article 20 (Special leave)
